Visitors to the www.MyMidlandMortgage.com website can browse our site anonymously by choosing not to provide us with personally identifiable information.
Midland Mortgage Co. ("Midland") does not use "cookies" to collect personal data. "Cookies" are pieces of information about your internet usage stored directly on your computer. PRIVACY NOTICE FOR MIDLAND MORTGAGE CO. CUSTOMERS
Federal law requires that we provide a copy of our privacy notice every year. If you
have already notified us of your privacy preferences, you do not have to notify us
again, unless you wish to make a change.
We Respect Your Privacy
Our customers care about privacy, and we share that concern. This notice describes
how "nonpublic personal information" is collected, secured and used by Midland Mortgage
Co., as the entity which services your loan, and its parent MidFirst Bank, as the
owner of the servicing rights to your loan. Information practices for products and
services offered by MidFirst are discussed in a separate MidFirst Bank privacy notice.
Information Accuracy
Keeping your information accurate and up to date is important. Please call or write
to us if your name, address, e-mail address or phone number change or if your account
information is inaccurate.
Collecting Information
As permitted by law, we collect "nonpublic personal information" about you from
the following sources:
- Completed forms such as your mortgage loan application, which includes your name, address, phone number, and/or date of birth;
- Your transactions with us, our affiliates, or others, including your original loan amount, current balance, date the account opened, and/or payment history;
- Consumer reporting agencies, for creditworthiness or credit history; and
- Other sources of information, such as surveys.
Securing Information
We maintain physical, electronic, and procedural safeguards to reasonably guard your
nonpublic personal information. We restrict access to employees who have a business
reason to use that information. Finally, we maintain procedures whereby parties
with whom customer information is shared are required to maintain that information
in a secure manner and use the information only for the purpose for which it
was provided.
With respect to accidental disclosure of customer information to disguised intention
(pretext) callers or other unrelated third parties, we maintain verification
procedures designed to limit disclosure of account information to (1) those
individuals named on the account; (2) those individuals for whom we have been
given express authorization by an account holder; and (3) other third parties
who are legally entitled to the information, such as government officials, in
compliance with the federal and state Financial Privacy Acts.
Managing Information
We may share certain information we collect among companies related to us by common
ownership or control, in compliance with the Fair Credit Reporting Act and other
applicable laws. This enhances our ability to serve you and may save you time
in opening new accounts. To the extent that we receive medical or health
information about you, we will not share it among our affiliated companies
except as necessary to maintain accounts, process transactions or provide
services that you have requested or initiated.
We may share all types of information we collect with other companies as permitted
or required by applicable law.
Often these include companies that perform services
on our behalf as part of our servicing responsibility, for example, data processing
and other technology services, and mail services. These companies are also required
to keep the information secure.
Other examples of instances in which we may share
all types of information we collect as permitted by law include the sharing of
information (1) with your consent, including the case where you have given someone
your power of attorney or other written authorization to act on your behalf;
and (2) in connection with a subpoena or other appropriate government request
for information, a fraud investigation or other legal process; and (3)
furnishing of information to a credit bureau as permitted by the Fair Credit
Reporting Act.
We may also use the information to inform you about valuable
opportunities such as life insurance, discount membership programs and other
products and services that we do not currently offer, but may be of interest to you.
In doing this, we may provide information to companies with which we have agreements
to jointly market those products and services, including financial service providers,
such as insurance providers; and non-financial companies, such as direct marketers of
discount membership programs and warranty programs. This information includes: (1)
information about you, including your name, address, telephone number, and/or date of birth;
and (2) your transactions with us, our affiliates, or others, including your original
loan amount or outstanding balance, date of account opening, and/or payment history.
Other than as described in this section or as otherwise permitted by law, we do not
sell customer lists or share your nonpublic personal information.
Your Preferences
You may direct us not to share information about you with third parties, other than
as permitted or required by law. If you have already directed us not to share
information about you with third parties other than as permitted by law, then
it is not necessary to notify us of your preferences unless you wish to receive
such information in the future. If the law of your home state requires financial
institutions to obtain your express permission before sharing your information
with third parties for the purpose of informing you about certain products or
services, then we will not share your personal information with nonaffiliated
third parties except as permitted by the law of your home state.
Privacy Preferences
If you prefer that we do not share your information other than as permitted by law, you
may not receive notice of new products, services, or discounts. We will comply with
instructions from either the Primary Borrower or the Co-Borrower.

- Using the Internet at www.MyMidlandMortgage.com through My Mortgage account access.

After your loan is paid in full or your relationship with us is otherwise terminated,
we will continue to adhere to the information practices described in this and subsequent
notices.
It may take up to 60 days to fully process your preferences.
